Summary: The client was parked in their vehicle on the shoulder of the Dallas North Tollway at 2:45 a.m. when a trooper pulled in behind them with his overhead lights activated. The trooper made contact with the client and noticed the odor of alcohol inside the vehicle. The client was subsequently arrested for DWI and found to have a blood alcohol concentration of 0.125. Following a motion to suppress hearing, the Court found that although the trooper may have been concerned for the client’s welfare, the client exhibited no signs of distress and was merely parked on the shoulder. The Court held that the vehicle stop should be suppressed, and that any evidence obtained was in violation of the client’s constitutional rights. As a result of the Court’s ruling, the State had no choice but to dismiss the case against the Texas Defense Firm client.
